(This is the ceremony before the licensed Marriage Officer or Home Affairs Officer – the date must also be after the Antenuptial contract is to be signed).

4. Will the Antenuptial contract include or exclude the accrual?

(If it includes the accrual system, then the parties share in each other’s estate after marriage. If it excludes the accrual system, then the parties will never share in each other’s estate after marriage)

6.1 If the Antenuptial contract includes the accrual system, please advise if there are any assets that need to be excluded from the estate of spouse 1:

If there are no assets, then simply state “no assets”. If assets are to be excluded, then kindly also provide description of such assets, eg property will require property description/physical address; if vehicle is excluded then make, model and vehicle registration is required; if policy then name and policy number as well as where policy is held

an antenuptial contract needs to be concluded before you have concluded all the formalities required for your customary marriage. If you have not concluded an antenuptial contract before this, you are deemed to be married in community of property.
